Article 1 – Definitions
In these general terms and conditions, the following terms are understood to mean:
- Budget Tegels: the company Budget Tegels, located in Zeeland, Noord-Brabant, Netherlands, registered with the Chamber of Commerce under number 93561903.
- Customer: any natural or legal person who enters into an agreement with Budget Tegels.
- Consumer: the customer who is not acting in the exercise of a profession or business.
- Business customer: the customer who is acting in the exercise of a profession or business.
- Agreement: any agreement between Budget Tegels and the customer, including purchase agreements, orders, quotations, reservations, deliveries, and collection orders.
- Products: all products offered by Budget Tegels, including but not limited to floor tiles, wall tiles, outdoor tiles, SPC, PVC, sanitary ware, adhesives, grouts, profiles, tile tools, tile accessories, clearance stock, samples, and other related items.
- Processed products: products that have been wholly or partly laid, glued, grouted, assembled, sawn, drilled, cut, adapted, installed, or otherwise put into use.
- Specially ordered products: products that have been specially ordered, composed, reserved, custom-made, adapted, or purchased for the customer and which cannot be resold without further ado.
- In writing: in writing also includes communication by email or other electronic means of communication.
- Delivery: the moment when the products are made available to the customer, delivered to the specified address, or collected by the customer.
Article 2 – Applicability
These general terms and conditions apply to all offers, quotations, invoices, orders, deliveries, collections, and agreements between Budget Tegels and the customer, unless otherwise agreed in writing.
By placing an order, accepting a quotation, or paying an invoice, the customer declares to agree to these general terms and conditions.
Deviations from these general terms and conditions are only valid if explicitly confirmed in writing by Budget Tegels.
The applicability of any purchase or other conditions of the customer is expressly excluded.
Budget Tegels reserves the right to amend these general terms and conditions. Amended terms and conditions apply to new agreements from the moment of publication.
Article 3 – Offers and quotations
All offers and quotations from Budget Tegels are without obligation, unless expressly stated otherwise.
Budget Tegels is not bound by obvious errors, clerical errors, printing errors, pricing errors, stock errors, or mistakes on the website, in quotations, or in other communication.
Images, mood photos, product examples, showroom models, color samples, and samples are indicative. Color, structure, gloss, dimensions, print, pattern, finish, shade, caliber, and batch may differ in practice.
Quotations are valid for 30 days, unless stated otherwise in writing.
Budget Tegels reserves the right to change prices, product information, and assortment.
Article 4 – Formation of the agreement
An agreement is formed as soon as Budget Tegels confirms an order in writing, sends an invoice, receives payment, or starts the execution of the order.
Budget Tegels reserves the right to refuse or cancel orders without stating reasons, or to impose additional conditions, for example in case of suspected fraud, incorrect data, or uncertainty about the order.
Changes to an order are only possible after written approval from Budget Tegels and only insofar as the order has not yet been processed, ordered, reserved, scheduled, packaged, or shipped.
Article 5 – Prices and Payment
All prices on the website include VAT, unless stated otherwise.
Shipping costs, pallet costs, transport surcharges, packaging, storage costs, and other additional costs are stated separately or included in the quotation.
Payment must be made via the offered payment methods or within the term stated on the invoice.
Budget Tegels is entitled to demand full or partial prepayment.
If the customer does not pay on time, Budget Tegels is entitled to suspend the performance of the agreement.
In case of late payment by a business customer, the business customer is legally in default and owes statutory commercial interest and extrajudicial collection costs.
All delivered products remain the property of Budget Tegels until full payment has been made.
Article 6 – Cancellation
Cancellation requests must always be submitted in writing.
For business customers, an order cannot be canceled free of charge after the formation of the agreement, unless Budget Tegels agrees to this in writing.
For consumers, the statutory right of withdrawal applies to standard online purchases, unless a statutory exception applies.
For specially ordered products, custom-made products, reserved batches, adapted products, or products that cannot be resold without further ado, free cancellation or return is not possible, insofar as the law permits.
If an order has already been processed, reserved, ordered from the supplier, scheduled for transport, packaged, or shipped, Budget Tegels is entitled to charge the costs incurred for this to the customer, insofar as legally permitted.
A cancellation request after 48 hours after ordering will only be considered by Budget Tegels if the order has not yet been processed, reserved, ordered, processed, or shipped. Holidays, weekends, and closing days may affect processing.
Article 7 – Delivery
Budget Tegels delivers in the Netherlands, the Benelux, Germany, and other areas on request.
Stated delivery times are indicative, unless expressly agreed otherwise in writing.
Exceeding a delivery time does not automatically entitle the customer to compensation.
The customer is responsible for providing correct address details, accessibility, and a suitable unloading location.
The customer must be present at the agreed delivery time, unless otherwise agreed in writing.
If the customer is not present at the time of delivery, delivery proves impossible, or a new delivery attempt is required, all additional costs, including new shipping costs, storage costs, transport costs, and re-delivery costs, will be borne entirely by the customer.
Budget Tegels is entitled to make partial deliveries.
Article 8 – Collection and loading
Upon collection, the customer must immediately check the products for correctness, quantity, breakage, and visible damage.
As soon as the products have been made available to the customer or loaded into the customer's vehicle or that of their carrier, the risk transfers to the customer.
Collection and transport by the customer or by a third party engaged by the customer is entirely at the customer's risk.
Budget Tegels is not liable for damage occurring during or after loading, stowing, stacking, securing, or transporting products by or on behalf of the customer.
Budget Tegels is not liable for damage to vehicles, trailers, cargo, or third parties resulting from incorrect, unsafe, faulty, or unsuitable loading or transport.
If products are loaded into an unsuitable or overloaded vehicle at the customer's request, this remains entirely at the customer's risk.
Article 9 – Inspection upon receipt and notification obligation
The customer must carefully inspect the order immediately upon receipt and always before processing for breakage, damage, quantity, size, shade, caliber, batch, decor, finish, and visible deviations.
Visible damage, breakage, shortages, or incorrectly delivered products must be noted immediately upon receipt on the delivery note or consignment note, if applicable.
Visible damage or breakage must be reported in writing to Budget Tegels within 48 hours of receipt at the latest, preferably with clear photos and a description of the problem.
Legal rights of consumers regarding hidden defects or non-conformity remain applicable.
Complaints will not be processed if products have already been processed, unless it concerns a defect that could not reasonably have been discovered before processing.
Article 10 – Processing of products
Products may only be processed after the customer has carried out all checks.
Processed products cannot be declared, returned, or claimed for visible, pre-checkable, or observable deviations upon receipt.
No claims will be accepted after processing visibly defective products.
Budget Tegels is not liable for damage arising from incorrect processing, incorrect assembly, unsuitable substrate, incorrect processing temperature, incorrect adhesive or grout choice, incorrect storage, incorrect maintenance, or improper use.
The customer remains responsible for checking whether a product is suitable for the intended application and space.
Article 11 – Batch, shade, caliber and cutting loss
Tiles, SPC, PVC and similar products may differ per batch, shade, caliber, size, print, structure or gloss.
Repeat orders may deviate from previous deliveries. Budget Tegels cannot guarantee that a repeat order will exactly match a previous batch, shade or caliber.
Such common deviations do not constitute a defect.
The customer is responsible for ordering a sufficient quantity, including cutting loss, reserve and any future replacement.
If the customer orders too little and has to reorder later, the risk of color, shade or batch difference is entirely at the customer's expense.
Article 12 – Right of withdrawal and returns
Consumers have the legal right to revoke the agreement for online purchases of standard products within 14 days of receipt, unless a legal exception applies.
To exercise the right of withdrawal, the customer must contact Budget Tegels in writing within this period.
Returns are only possible for complete, unused, unprocessed, undamaged products in original and undamaged packaging.
Returns will only be accepted after written approval from Budget Tegels.
Specially ordered products, custom-made products, residual stock, samples, adhesives, grouts, sealants, leveling compounds, opened consumables, and processed products cannot be returned, unless mandatory law stipulates otherwise.
Return costs, return transport, and the risk of return shipment are for the account of the customer, unless otherwise agreed in writing or legally stipulated otherwise.
Budget Tegels reserves the right to refuse returns if the return conditions have not been met.
If Budget Tegels, out of goodwill, accepts a return outside of a legally mandated right of withdrawal, Budget Tegels may charge a restocking fee, depreciation, inspection costs, transportation costs, and other reasonable costs.
Article 13 – Complaints and warranty
Complaints must be submitted in writing and sufficiently clearly described.
Complaints do not give the customer the right to suspend payment.
Budget Tegels is not responsible for damage resulting from improper use, storage, processing, assembly, maintenance, or application of the products.
Budget Tegels provides no further warranty than the warranty it receives from its supplier or manufacturer, unless otherwise stated in writing.
Statutory rights of consumers remain fully applicable.
Article 14 – Liability
Budget Tegels is not liable for indirect damage, consequential damage, lost profit, stagnation damage, delay damage, assembly costs, disassembly costs, third-party labor costs, loss of rent, missed savings, or other derived damage, unless there is intent, conscious recklessness, or mandatory law.
Budget Tegels is not liable for damage resulting from incorrect processing, incorrect assembly, incorrect loading, loading, transportation, storage, or use of the delivered products by the customer or by third parties.
Budget Tegels is not liable for damage that occurs because products are loaded into an incorrect, unsafe, unsuitable, or overloaded vehicle at the customer's request.
Budget Tegels is not liable for differences in color, structure, batch, tint, caliber, dimensions, print, or finish that are common within the nature of the product or only become visible with reorders.
Any liability of Budget Tegels is limited to a maximum of the invoice amount of the relevant part of the order, unless mandatory law stipulates otherwise.
Limitations of liability do not apply if the damage is the result of intent or conscious recklessness on the part of Budget Tegels.
Article 15 – Force majeure
In case of force majeure, Budget Tegels has the right to suspend the execution of the agreement or to dissolve it in whole or in part without any obligation to pay damages.
Force majeure includes, but is not limited to, breakdowns, transport problems, delays with suppliers, fire, illness, pandemics, government measures, weather conditions, war, cyber incidents, strikes, and other circumstances beyond the control of Budget Tegels.
If Budget Tegels has already partially fulfilled its obligations when force majeure occurs, it is entitled to invoice this part separately.
Article 16 – Privacy
Budget Tegels processes personal data in accordance with applicable privacy legislation.
Personal data will only be used for order processing, delivery, customer service, administration, marketing where permitted, and fraud prevention.

Article 17 – Disputes and applicable law
All legal relationships between Budget Tegels and the customer are exclusively governed by Dutch law.
Disputes between Budget Tegels and business customers will be submitted to the competent court in the district where Budget Tegels is located.
Disputes with consumers will be submitted to the legally competent court.
Article 18 – Final provisions
If a provision of these general terms and conditions proves to be wholly or partly voidable, void, or unenforceable, the remaining provisions will remain in full force and effect.
In that case, the parties will replace the provision concerned with a provision that corresponds as closely as possible to the purpose and intent of the original provision.
If Budget Tegels deviates from these general terms and conditions in an individual case, no rights can be derived from this for other cases.
